These Terms and Conditions are a contract between subscription members, expatriate partners, providers, or visitors (collectively, “you” or “your”) and The Barriffe Insurance Group. Our commitments as a service provider and your obligations are outlined.

Introduction:

Welcome to The Barriffe Insurance Group! The following terms and conditions govern the use of The Barriffe Insurance Group (BIG) website located at (www.barriffeinsurancegroup.com). By accessing or using our website(s), you indicate that you have read and agree to comply with and be bound by the Terms and Conditions detailed below. If you do not agree, please exit this or any other site owned and operated by The Barriffe Insurance Group. 

Last updated on October 15, 2024. The terms have been updated to clarity and transparency, which are in alignment with our business mission and values. The updates include requirements for subscribers who participate in our partner donation program, which helps to subsidize health care access for our health subscription members.

Use of the Site:

  • You must be at least 18 years old to use this website.
  • You agree to use the website only for lawful purposes and in accordance with these Terms.

Payments and Pricing:

Unless otherwise noted, you and your expatriate partner are responsible for paying your subscription fees based on the pricing of selected plans. The pricing details and responsibilities for both expatriate partners and health subscription members are outlined in your plan. To review your payment responsibilities, see the plan description in your account profile.

BIG Health Subscription Plans: Use of our services generally requires expatriate partners and subscription members to pay a yearly auto-renewal fee in addition to the monthly subscription fee based on the chosen subscription plan. The subscription plan consists of the buy-in and subscription fees. The health subscription pricing plan may vary by region and includes information set out in the health subscription offer details and pricing page. We may update or amend the pricing plans from time to time to account for inflation and changes in the healthcare enterprise. The terms of the health subscription plan form part of these Terms & Conditions. 

As with any other changes to our Terms & Conditions, changes to the pricing plan will not apply retrospectively. If and when changes are made, BIG will make every effort to notify both expatriate partners and health subscription members. Changes to your subscription plan can be made on your account profile. Depending on the time elapsed in your annual subscription period, upgraded changes to your health subscription plan may require a higher buy-in fee. Depending on your expatriate country location or method of payment, subscription fees may be inclusive or exclusive of transactional taxes where relevant (including but not limited to value-added taxes VAT, and goods and services taxes, GST), and are not reflected in the health subscription pricing plan.

Privacy Policy:

BIG uses your data solely to provide our services to you. In our fundraising campaigns, aggregated de-identified data may be used to acquire donations in order to ensure continued subsidized health memberships. Your use of the website is also governed by our Data Protections & Privacy Policy, which outlines how we collect, use, and protect your information.

Intellectual Property Rights:

All content published and made available on this website is the property of The Barriffe Insurance Group, the website’s creators, and its licensors and is protected by trademark, copyright, and other property laws. This includes, but is not limited to images, text, graphics, logos, documents, downloadable files, and software. Any reproduction, copying, reuse, or repurposing of the content of this website for commercial or non-commercial use without obtaining permission from The Barriffe Insurance Group is prohibited. Accounts:

We take reasonable precautions in line with international laws and industry standards to protect your confidential information, and we expect you to play your part. 

When you create an account or enroll in a health subscription membership on our website, you agree to the following:

Keeping it confidential:

  1. You are solely responsible for the account and the security and privacy of your account, including passwords or sensitive information attached to that account.
  2. All personal information you provide to us through your account is up to date, accurate, and truthful, and that you will update your personal information when they are changed.
  3. You agree to take reasonable steps to ensure both your information and our confidential information is not accessed by unauthorized individuals. 
  4. You are responsible for all invited users' activity on your account.

User Conduct:

Users are prohibited from:

  • Engaging in any activity that disrupts or interferes with the website.
  • Uploading or sharing content that is unlawful or harmful.
  • Sharing confidential information with unauthorized individuals.

Termination:

As health subscription members and partners, you may terminate your subscription with one month’s written notice. BIG may also terminate your subscription within this same one-month notification time frame. If you violate these terms, we may terminate your subscription immediately in accordance with the exceptions outlined below. If your subscription is terminated, no refunds are applicable, but rest assured, members and their partners are only responsible for services or claims that have been provided to you.

Subscription period: Your subscription continues for the period covered by the subscription fee paid or payable. 

Termination by you: You may choose to terminate your health subscription at any time by providing BIG with one month’s advance written notice. Health subscription members and their partners will still need to pay all relevant fees up to and including the end of the annual subscription period. 

 

Termination or suspension by BIG: We reserve the right to suspend or terminate your account or health subscription at any time without notice if:

  • you are using our website or services illegally
  • either the expatriate partner or health subscription member misses more than 3 consecutive or 3 total payments within a subscription period without providing written notice of financial hardship
  • if you violate these terms and conditions

If you fail to pay health subscription fees, we will take reasonable steps to notify you of failure. Subject to the processing and payment timing or your bank or credit or debit card provider:

  • if either the expatriate partner or health subscription member does not pay within 7 days from which subscription fees became due and payable, BIG will send you a reminder
  • if either the expatriate partner or health subscription member does not pay within 14 days from which subscription fees became due and payable, BIG will send you a reminder
  • if either the expatriate partner or health subscription member does not pay within 21 days from which subscription fees became due and payable, BIG will send you a reminder
  • if either the expatriate partner or health subscription member does not pay within 30 days on which subscription fees became due and payable and we have not received written notice of financial hardship, BIG will suspend your subscription 

In the event of suspension or termination, members reactivate their subscription by paying all outstanding subscription fees in full.

Refund Policy:

Any purchases or services made payable on our Site is not refundable. 

No Warranty:

The website and all its content are provided “as is” and without warranties of any kind or nature, express or implied, including but not limited to implied warranties for any particular use or purpose. We do not guarantee the accuracy or completeness of any information on the website. 

Third Party Goods and Services:

The website may also offer goods and services from third-parties. We cannot guarantee the quality or accuracy of goods and services made available by third-parties on our website.

Links to other websites:

Our website may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to our website. It is your responsibility to read the Terms and Conditions and Privacy Policy of these third-party websites before using these sites.

Limitation of Liability:

The Barriffe Insurance Group, our managers, officers, agents, employees, subsidiaries, and affiliates shall not be liable for any actions, claims, losses, damages, liabilities, and expenses, including but not limited to legal fees arising from your use of the website, including indirect or consequential losses.

Indemnity:

Changes to Terms:

These terms are reviewed regularly to ensure compliance with legal standards and best practices. Therefore, we reserve the right to amend these Terms and Conditions at any time. Provisions that are deemed void will be removed from the Terms and Conditions. All other provisions unaffected will remain. Changes will be posted on this page, and continued use of the website constitutes acceptance of such changes.

Governing Law:

These Terms are governed by the laws of the country in which we provide membership services, including Jamaica.

Enforcement of Terms:

Whereby there are parts of these terms that either party is unable to enforce, those can be ignored, but everything else will remain enforceable.
